Terms of Use
1. What VIA is
VIA (“Virtual Intelligence Assistant”) is an AI assistant HUD for Second Life, built by an independent third party. It is not an official Linden Lab product and is not affiliated with Linden Research, Inc.
2. License
Getting VIA (by joining the “VIA Lab” group in Second Life) grants you a personal, non-exclusive, non-transferable license to use the HUD within Second Life.
You may not resell, copy, redistribute, decompile or transfer the HUD to third parties. The HUD is tied to your account/avatar.
3. Third-party AI (Google Gemini)
VIA runs on the Google Gemini API under a “bring your own key” (BYOK) model: you use your own Google account and key. The messages you send to VIA are transmitted to Google to generate replies and are subject to Google's terms and privacy policy.
VIA neither controls nor is responsible for Google's service. You are responsible for the use, costs and limits of your Google Gemini account.
4. Payments, fees and refunds
VIA is offered for a payment in Linden dollars (L$) to join the VIA Lab group and, after the final release, a recurring maintenance fee that will be clearly announced. Amounts are shown on the pricing page.
Payments are made in Linden dollars (L$) within Second Life and are governed by Linden Lab's Terms of Service. In line with standard Second Life practice, no refunds are issued unless the product is defective or does not work as described. The Pioneer program is a closed beta with the conditions described in the offer.
5. Beta and availability
VIA is provided “as is” and “as available.” It is an evolving product (beta): features may change and there may be downtime, maintenance or bugs. We make reasonable efforts to keep the service running but do not guarantee uninterrupted availability.
6. Acceptable use
You agree to use VIA in accordance with the Second Life Terms of Service and applicable law, and not to use it for unlawful or abusive activities or to infringe the rights of others.
7. Intellectual property
The VIA HUD, its code, brand, texts and materials belong to its owner. This license transfers no intellectual property rights to you.
8. Limitation of liability
To the extent permitted by law, VIA and its owner shall not be liable for indirect damages, data loss, lost profits or harm arising from the use or inability to use the HUD, nor for the behavior of the third-party AI model. VIA is not a substitute for professional advice.
9. Changes to these terms
We may update these terms. The “last updated” date reflects the version in force. Continued use of VIA after a change means you accept it.
10. Governing law
Transactions take place within Second Life and are subject to Linden Lab's Terms of Service. Otherwise, these terms are governed by the laws of Spain, without prejudice to any consumer rights you may have in your place of residence.
Privacy & Data Protection
1. Data controller
The controller of your data is Lino Prieto. For any privacy question you can contact him in Second Life by sending an instant message (IM) to his account, “Lino Prieto.”
2. What data we process
To provide the service we process: (a) your Second Life identity (avatar name and UUID); (b) the messages you send to VIA; (c) the “memory” VIA builds about you from what you tell it (e.g. your tastes, friends and favorite places you choose to save); (d) your Google Gemini API key, needed for VIA to query the model on your behalf; and (e) technical operating data (basic usage and error logs).
3. Purpose and legal basis
We process this data to provide and maintain the assistant service: replying, remembering your preferences and running the HUD's features. The legal basis is the performance of the service you request and your consent when using VIA.
4. Processing by the AI (Google)
The messages you send to VIA are transmitted to Google (Gemini), using your own key, to generate replies. That processing is governed by Google's policies. We do not sell your data or use it for purposes unrelated to the service.
5. Retention
We keep your memory and data while you use VIA. You can request deletion at any time; when you stop using the service or upon your request, we delete or anonymize the data unless we are legally required to keep it.
6. Recipients
We do not share your data with third parties for commercial purposes. The necessary providers involved are our server hosting provider and Google (AI model). Each processes data under its own terms.
7. Your rights
You can exercise your rights of access, rectification, erasure, objection, restriction and portability by contacting the “Lino Prieto” account in Second Life (instant message). If you reside in the EU/EEA, you also have the right to lodge a complaint with your data protection authority.
8. Security
We apply reasonable technical and organizational measures to protect your data, including your API key. No system is 100% secure; we recommend you safeguard your credentials.
9. Minors
VIA is aimed at Second Life users who meet the minimum age required by Linden Lab and their jurisdiction. It is not intended for minors.
10. Cookies (website)
This website uses no tracking or advertising cookies. Only the strictly necessary technical storage is used, where applicable, to remember your language.
